| 摘 要： | 保护物权是维护权利人合法权益,定分止争,创造社会财富充分涌流局面的必然要求。我国古代法通过对动产与不动产的区分,建立了与当时当地生产力发展水平相适应的物权保护制度。西方传统民法在发展中逐步建立了物权保护机制,尤其是德国民法典确立了＂基于所有权的请求权＂,奠定了整个大陆法系近代私法与近代物权法的基础。现在,我国建立了与社会主义市场经济体制相适应的法律制度,物权保护能力得到强化。但进一步充分发挥物的效用,推动经济社会实现科学发展,仍应充分吸取古今中外法治文明的优秀成果,完善宪法、民法、刑法、行政法、诉讼法的具体保护措施,科学构建现代物权保护制度,使物权的法律保护机制更加适应经济社会科学发展、构建社会主义和谐社会的需要。

| Abstract: | The law which enhances the protection of right in rem of property is to support the legal rights in person,stop crimes in the right of property,and promote social wealth to flow in its right way.In ancient China,the differentiation of movable and immovable properties in the legal system established a protection system adapting to the level of productive force at that time,while in the western countries,the protection mechanism of the right in rem of property were gradually established in the developing process of civil law,especially in German which established the ＂claim power based on the proprietorship＂,providing a solid foundation for the European continental legal framework in contemporary private law and contemporary right in rem of property.At present,China has established a legal system adapting to the system of socialist market economy,which strengthens the protection power of the right in rem of property,but further perfection of legal system and scientific development of China still need the absorption of the essence of laws from home and abroad. |
