| 摘 要： | 运用文献调研、参与式观察、无结构访谈等方法,以金斗洋畲族武术传承人的村落治理实践为研究主题,探讨村落礼治、法治及礼法合治是如何以村落武术或村落武术传承人为媒介而推行的。研究发现,金斗洋畲族村的村落治理延续了传统的礼治方式,畲族武术的"在野之礼"成为村落治理的工具;在畲族武术传承人授武场域、授徒性别选择、用武方式等方面将法律的相关内容融入其中,促生了"以礼入法"行为的实践达成。研究认为,以武术的"在野之礼"等形成的村落治理传统并不会随着村落普法的推进而在短时间内消亡,"礼法合治"将是当前转型时期村落社会治理的重要形式,并伴随乡土社会的发展持续产生效能,村落武术之礼文化及传承人的身体力行成为这种治理格局型塑的重要媒介。 |

| Abstract: | This paper used literature study,participatory observation,unstructured interview and other research methods in order to reveal how the village governance practice of the Jindou Yangshe ethnic Wushu inheritors played in village ruling,rule of law and ritual and law governance.It was found that the village governance continued through the traditional rituals.The "folk ritual" of the She ethnic Wushu became a tool for village governance.The legal content was put into the Wushu field,the selection of inheritor's gender and the way of using Wushu, which promoted the practice of "introducing the law into the ceremony".The study held that the village governance tradition formed by the "folk ritual" of Wushu would not disappear in a short period of time with the advancement of the village law."The joint governance of laws" would be an important form of village social governance in the current transition period.With the continuous development of the development of the local society,the ceremonial culture of the village Wushu and the physical strength of the inheritors became an important medium for this governance pattern. |
