| 摘 要： | 教练员合同属于劳动合同，但属于具有体育行业特殊性的劳动合同。国际体育仲裁院通过其裁判实践，确立了各国普遍承认的、符合体育行业规律的教练员合同规则。无论是用人单位，还是教练员，都不能预告解除固定期限的劳动合同。仅在一方当事人违约，且构成解约正当理由时，另一方当事人才可以提前解除劳动合同。大量裁决实践已经确认了构成解约正当理由的若干事实类型。当事人一方违约致使他方解除合同，或者无正当理由解除合同的，应当赔偿损害。损害赔偿范围等于未履行完毕合同期限的工资总和。裁判实践还确认了当事人约定违约金的权利。国际体育仲裁院确立的规则与我国劳动合同法有关规定不一致，尤其是涉及合同解除及劳动者倾斜保护的规定。裁判规则不仅可以作为我国涉外教练员合同当事人维护合法权益的依据，还可以为我国构建符合体育行业规律的教练员合同制度提供参考。

| Abstract: | The coach's contract is categorized as employment contract. The Court of Arbitration for Sports has developed a generally acknowledged body of rules suitable for of coach's contract in the sports field. In accordance to those rules, the coach shall not terminate contract before contractual term, nor shall the employer. Only in the event of existence of just cause, one party of the coach's contract shall terminate contract during contractual term. Court of Arbitration for Sport has interpreted just cause in many circumstances. The party terminating contract without just cause is obliged to compensation. Amount of compensation is equivalent to residual value of contract, which is usually higher as amount ruled in accordance with Chinese Labor Contract Act. In contrast to Chinese law, liquidated damages is allowed. These rules not only provide guidance in protecting party's legitimate rights in coach's contract with foreign coaches, but also can be consulted in amending relevant rules in the Chinese law. |
