| 摘 要： | 本文通过“法治”概念的重新探讨,指出真正的“法治”应该是以民主为基础的“法律至上”,同时还应该和道德有着紧密的联系。中国的“法治”思想起源于法家的“法治”思想,西方社会的“法治”思想渊源于亚里士多德的“法治”概念。中国要尽快实现社会主义“法治”,必须对西方社会所代意义上的“法治”有明确的认识,同时,要从多重维度实现我国的“法治”。

| Abstract: | Through approaching the concept of the rule by law again, this article shows the genuine rule by law should be based on democracy with"Law First".Meanwhile, it ought to be closely related to morality.The Chinese thought of rule by law derived from that of Legalists,however,the western one came from that of Aristotle.If we want to accomplish socialist rule by law in China as soon as possible,we must have a good understanding of modern western ideas of the rule by law.At the same time,rule by law must be achieved from different dimentions. |
