| 摘 要： | 修订后的《婚姻法》增加了有关探望权的规定，赋予离婚后不直接抚养子女的父或母有探望子女的权利，同时也规定了直接抚养子女的父或母必须履行协助另一方探望子女的义务。这是一条很有人文意义的规定，对离婚双方及其子女的亲权起着重要的保护作用，是我国婚姻立法不断完善、进步的标志：但这项规定尚存在许多不足，需今后在立法上进一步完善。

| Abstract: | Provisions relating to visiting right has been added to revised 《Marriage law》, which gives the parents who don＇t have direct fostering right the visiting right, in the meantime, regulates another party to provide assistance of fulfilling the obligation to the counterpart. This is a provision with much humanistic meaning playing significant role in protecting the parental rights of the children and the both sides of the divorce and a sign of continuous improvement of the marriage legislation in China. The provision still has defects to be improved in legislation in the future. |
