| 摘 要： | 目前我国重点生态功能区的土地管理主要采用国家行政强制或法律管制来限制土地利用的传统方式。而域外发达国家生态补偿则采用激励性机制，主要表现为生态补偿标准市场化、明晰自然资源产权、公众实质性参与、补偿资金来源政府与市场双重驱动。国外先进的立法经验对我国重点生态功能区生态补偿法律制度设计具有重要启示。应建立生态补偿专门机构、实行科学合理的生态补偿标准、完善自然资源产权制度、加强社区实质性参与、健全财政金融法律，构建我国重点生态功能区生态补偿激励性法律机制。

Research on Legal Incentive Mechanism of Key Ecological Function Areas Eco-Compensation in Perspective of Comparative Analysis |

| Abstract: | Currently ,land management in key ecological function areas in our country is the traditional mode by means of administrative regulation or legal restriction to restrict the land usage .However ,incentive measures are taken in developed countries'eco‐compensation , such as marketization of eco‐compensation standard ,clarifying natural resources property rights ,substantive public participation and dual drive of com‐pensation funds sources from both the government and the market .Advanced legislation experiences overseas provide important enlightenments to our country's key ecological function areas eco‐compensation legal sys‐tem .In order to build incentive legal mechanism of key ecological function areas eco‐compensation in our country ,specialized agency should be established ,scientific and reasonable ecological compensation standard should be carried out ,the property right system of natural resources should be perfected ,substantial com‐munity participation should be strengthened ,and the financial laws should be improved . |
