| 摘 要： | 正当防卫是刑法理论中违法性阻却事由之一，也是各国刑事立法所确立的一项重要制度。“受虐妇女综合症”理论作为正当防卫的可采证据，已广泛运用在西方的司法实践中，我国的正当防卫制度也遭到该理论的冲击。我们应将“受虐妇女综合症”作为专家证言引入正当防卫的可采证据，以体现司法公正和对受虐者人身权益的保障。
