| 摘 要： | 既选择仲裁又选择诉讼的仲裁协议包括终局性不确定的仲裁协议和浮动仲裁协议两种表现形式。其形成具有多种原因。在我国目前的立法和仲裁实践中，该种仲裁协议一般被认定为无效。其实，该种仲裁协议不应一律视为无效。

| Abstract: | Mediatorial agreement which chooses both mediation and litigation includes two expressive forms—eventually uncertain mediatorial agreement and floating mediatorial agreement.There are many reasons which leads to its forming.In mediatorial practice and present Chinese legislation,this kind of mediatorial agreement is ineffective.In fact,it should not be always ineffective. |
