| 摘 要： | 法治建设不仅包含中央政府对全国法治的顶层设计,还包括地方各级政府的法治构建。由于"地方"的区域性、基层性、自主性和差异性等基本属性,地方法治建设不仅已成国家法治建设进程中实践性最强、基础性最广、地方自主性发挥空间最大的部分,也已成我国法治建设中可能性最多,差异性最大的部分。作为地方法治建设的着力点,地方法治社会建设应具充分的发展空间,为此,我们要在符合中共中央作出的我国法治建设总体部署的前提下,在维护我国法制统一原则的基础上,结合地方实际情况,重塑地方社会的治理模式,通过法治和其他社会治理手段的共同运用,实现地方治理权力行使的法治化和规范化、实现地方治理权力在政府、社会团体、经济组织、公民个人之间的重新分配。这种路径的设置不仅符合十八届四中全会作出的"建立重心下移、力量下沉的法治工作机制"的重要指示精神,也将为实现我国国家治理体系的现代化起到重要作用。

| Abstract: | Legal construction consists of which with local governments at all levels as well as which with central power. Local governments＇ essential attributes, such as Locality, primality, autonomy and diversity, make them not only the pri- mary and most practical, autonomous part, but also the most uncertain and viable part of China＇s legal construction. Am- ple development space shall be given to local legal construction which is the origin of force of local legal construction. For the purpose, exercising local power legally normally, and reallocation of legal power among governments, social organiza- tions, economic organizations and citizens shall be realized to reconstruct local governance models by legal and other means, under the overall scheme by CPC central committee, under the uniformity of legal system, and under reconciliation with local reality. This approach conforms to the important instruction that to establish the working mechanism of rule of law with downward shifting focuses and power, and shall play an important role in the modernization of China＇s management system. |
