| 摘 要： | 刑事被害人人身损害的救济是刑事诉讼中人权保障的重要内容。由于我国现行的刑事被害人人身损害的法定救济方式仅为犯罪人赔偿一种,以致于在司法实践中,很多刑事被害人或其家属难以获得及时、足额的赔偿。为此,有必要构建以犯罪人赔偿为主体,以国家补偿、社会救助和社会保险为补充的刑事被害人人身损害的多元化救济制度,以切实保障刑事被害人的合法权益。
