| 摘 要： | 程序正义是一种看得见的正义,程序有其存在的独立价值,因而是真正的正义所在,中国的诉讼改革中,只有真正引入程序正当主义,彻底改变司法实践中"重实体、轻程序"的落后观,在诉讼程序中,确立法官中立的司法理念,改变制约法官中立的各种制度,唤起人们对法官职业的尊重,才能从根本上解决司法不公的现状,也才能确保司法公正,维护司法这条保障人民权利的底线。

| Abstract: | Procedure justice is justice before truth,procedure has it's independent value,therefore it's where the true justice based on.the process of China's justice revolution,only import procedure justice,completely change the outdated perception of focus on real existence and ignore procedure justice in nowadays practice of justice.Form judge independent justice concept in the justice procedure,change all systems which hindered judge independence,recall the respect of judge independence,only after the above ways,can we solve the current situation of unfair justice,guarantee the fair justice,protect justice which is the bottom line to protect civil rights. |
