| 摘 要： | 文章力图克服法学界对政府监管研究的传统思路，运用成本——收益的经济分析范式对政府监管进行探讨。文章首先对政府监管的成本及收益进行了界定，进而通过经济分析认为，实现政府监管效益最大化应从降低交易成本着手，但同时也应注意制度供需均衡问题。

| Abstract: | In this article,the author tries to transcend traditional legal ways in government regulation research and employ the cost-benefit paradigm to make an analysis. The cost and benefit of government regulation is defined at first,and then it is opined that the government regulation should reduce the cost in order to maximize the effficency and that attention be paid to the equilibrium of supply and demand of the institution. |
