| 摘 要： | 犯罪控制与人权保障之间呈现一种对立统一的关系。对于二者冲突解决机制的构建，可以通过构建一系列的监督保障机制，使二者达成一种动态平衡的态势，为其提供外部保障。而对内则可寻求通过转换警察的角色定位，加强法制教育和培养人权意识，解决执法者的价值观问题。在评价犯罪控制措施的时候，可以运用经济分析的方法对其成本和效益进行比较。二者冲突的解决有助于实现犯罪控制的最大化社会效益。

| Abstract: | The relationship of the crime control and the human rights protection is unification of opposites. Conflict solution mechanism can be built up through a series of surveillance to safeguard the mechanism which can enable the two to achieve one kind of dynamical equilibrium. On the other hand, measures can be done to transform the role orientation of the police, strengthen the legal education and raise their human rights consciousness to solve the problem of value views. In evaluating crime control measures, we may compare the cost and benit with the method of economic analysis. This conflict solution is helpful to maximize the social efficiency of the crime control. |
