| 摘 要： | 近年来，未成年人犯罪呈上升趋势，这一问题已经引起全社会的高度关注和重视。对未成年人犯罪的惩戒，核心价值不在于报应和震慑，解决问题的关键在于弱化、消除犯罪行为对社会造成的不良影响，侧重于对未成年人的身心矫治。检察机关运用刑事和解、暂缓起诉、社区矫正等“恢复性司法”制度处理未成年人犯罪，取得了良好的社会效果。运用“恢复性司法”处理未成年人犯罪，既有赖于立法的支撑，更有赖于司法的践行。

| Abstract: | In recent years, juvenile＇s crime has increasingly up warded, which has arouses the high concern and importance in the whole sociality. The punishment of juveniles crimes＇ core value is not the judgment and frighten but the core to the problem is to eliminate and reduce the bad influence of juveniles crime to the sociality, and attache more importance to the correction the juveniles＇ mind and body. Procuratorial office uses criminal reconciliation, community correction and such res to deal with the juvenile＇ s crime and gains some better social effects. Using to deal with juveniles crime is good to be the support of building up the law but is better to the practice of the law. |
