| 摘 要： | 对实务案件审判结果和理论界观点的对比分析，指出定牌加工行为的概念及其法律特征。实践和理论中的定牌加工行为有些被认定为商标侵权，有的则反而不被认为是商标侵权。实际上，定牌加工行为既是一种《合同法》意义上的加工承揽合同关系，又是一种《商标法》上的商标使用许可合同关系。考虑到定牌加工行为对外贸的积极作用，文章认为无论是司法实践还是理论研究，定牌加工行为都不应轻易地被判定为商标侵权。

| Abstract: | Through the comparative analysis of practice trial results and theory viewpoints,the article points out the concept and legal characteristics of original equipment manufacture.In fact,original equipment manufacture is not only an assuming contact relationship in contract law but also a trademark licence contract relationship in trademark law.Considering the positive effects of original equipment manufacture in foreign trade,the article thinks that original equipment manufacture must not be easily judged for trademark infringement whether in judicial practice or theoretical research. |
