| 摘 要： | 诱惑侦查是收集证据、证实隐蔽犯罪的有效手段，在刑事诉讼特别是贩毒案件的侦破中得到了越来越多的运用，但它同时也存在着侵害人权、陷民入罪的危险。面对这两难的选择，既要发挥诱惑侦查在打击犯罪、预防犯罪方面的积极作用，更要保障无辜公民免被陷于侦查圈套而成为罪犯。只有将诱惑侦查纳入法制化的轨道，赋予因受到侦查机关设计的侦查圈套而陷此情境的被告人以合法辩护的权利，才能控制、减少诱惑侦查的不当运用及其带来的负面影响。
