| 摘 要： | 正确处理公民权利与国家权力的关系十分必要。权力的权威性和强制性是权利的集中化表现，法由国家权力予以保障，公民权利在国家强制力的保障下得以实现。权力不能完全独立和超越于权利，要由权利来制衡。社会主义国家的国体决定了国家权力应以最大限度地保障公民的权力为目的，切实做到用民主制度制约权力，实现以权利制约权力，达到法治社会的目的。

| Abstract: | It is necessary to handle the relation between rights and powers. The authority and forcible of power originate from concentration to right, and law is only realized under power provid for protection, and right does so. Power can't completely independence with overstep in the rights, so it should be binded to balance by rights. The national power who is decided by the national prestige of the socialism country should purpose to guarantee that the citizen's right can be realized at maximum, and power should be truly limited through democration system to arrive use rights bind the power in order to govern society by law methods . |
