| 摘 要： | 由于清代国家统治能力的有限以及正式法律制度层面的缺失,清代重庆工商团体在行业纠纷解决中扮演着重要角色。清代司法档案等史料表明,当时相当数量的行业纠纷是通过工商团体调处得以化解的。工商团体实施的行业纠纷民间调处得到了清代国家的认可与支持,从而成为清代社会纠纷解决机制的重要组成部分;同时,清代国家还通过各种形式对工商团体实施的调处进行监督、施加影响,以保证调处始终处在国家允许的范围内,从而达到国家控制社会的目的。

| Abstract: | As a result of the limitation of state power and lack of the state law in the Qing Dynasty,the commercial organizations were endowed with more self-determination power by the state.According to historical data of,a great deal of the commercial dispute was resolved by the commercial organizations,and the civil mediation became an important part of the mechanism of dispute settlement in the Qing Dynasty.On the other hands,the government exerted influence on the commercial dispute in order to control the civil meditation in the range of the state permission. |
