| 摘 要： | 现代科技和经济的迅猛发展既给人类物质生活带来了空前繁荣，同时也带来了对环境的破坏。长期以来，国内产生了对环境权性质是公权利还是私权利以及运用公法保护还是私法保护的争论。事实上，这种争论是有益的，突显出了环境权及其保护的重要性。依靠单一的公法或私法对环境权实施保护都存在着不足，把环境权的保护置于人权的视角下予以整体保护才是科学而有效的。

| Abstract: | The rapid development of modem economy and technology has brought unprecedented prosperity to human＇s material life, but it also brings damage to the environment. For a long time, debate has it that the nature of environment right is common right or private right and use common law or private law to protect. In fact, this debate is useful, highlighting the envi- ronment right in the field of human rights and the improtanee of protection. We believe that relying on a single common or private law on the implementation of the right to the environment protection remains insufficient. Place the protection of environment right under the human right perspective for overall protection is scientific and effective. |
