| 摘 要： | 2004年宪法修正案将“国家尊重和保障人权”写入宪法,为私人财产权的保障提供了坚实的理论基础和依据。鉴于这种保障的力度与现实的法权要求存在差距,以及现实中私人财产权受侵害事例的广泛存在,有必要在宪法中规定正当程序原则,明确规定征收征用公平补偿的唇齿条款,制定对弱势群体的财产权予以保障的相应条款,完善有关人权保障的各项制度。

| Abstract: | In the 2004 constitutional amendment,"the country will revere and safeguard human rights"is entered in the constitution,which has provided the solid rationale and the basis for the personal property rights safeguard.But the strength of this safeguard has gap with the requirements of practical law rights and the invasion of personal property rights exists widely in the society.Therefore,it is necessary to put the principle of due process and the articles of compensating fairly to the collection and confiscation definitely into the constitution,to enact corresponding articles to safeguard their property rights for the weak group and to consummate each system about human rights safeguard of constitution itself. |
