| 摘 要： | 环境犯罪严重而刑罚少，环境犯罪构成要件难以确定是关键因素。而国内对其研究者颇少，对环境犯罪构成要件的界定探讨可以为立法司法实践与理论研究提供材料。为此，首先明确其概念，确定界定的原则依据，然后对环境犯罪构成要件三方面内容及其层次、排列顺序进行论证，最后分析了环境犯罪构成要件应该包括的要素，通过国内外对比分析，突破传统犯罪四要件说，确立了环境犯罪构成要件三要素说。

| Abstract: | With economy development, environmental crime is getting mote serious hereinafter but less punished. The phenomenon above is basically attributed difficulty in definitng constitutive factors of environmental crime(hereinafter called CFEC). As a result, research on CFEC is very valuable in the domains of the theory and practice. After giving the definition and principle basis to CFEC, the author demonstrates the content, levels and order of CFEC, and analyses the major factors of it. Through contract analysis, the anthor promotes three constitutive factors of CFEC instead of the four constitutive factors of traditional crime. |
