| 摘 要： | 司法实践中,有的行为人明知非法处置危险废物会发生严重危害后果而放任该结果发生,对于这种行为应如何定性?本文认为:重大环境污染事故罪的主观方面只能是过失,因此对于上述行为不能定重大环境污染事故罪,而应按照以危险方法危害公共安全罪定罪处罚。
