| 摘 要： | 在高校实施的教育教学活动或者高校组织的校外活动中，以及在高校负有管理责任的校舍、场地、其他教育教学设施、生活设施内发生的，造成在校大学生人身损害事故，其处理应当根据损害行为、损害后果、损害行为与损害后果之间是否有因果关系以及相关当事人的行为过错程度，按照法律法规的有关规定进行，侵害人应该承担相应的法律责任。
