| 摘 要： | 国际法与国内法关系存在“一元论”和“二元论”两种学说。本文从国际法效力依据、国家主权、条约保留、国家责任四个方面对国际法与国内法的关系进行了论述,并据此具体分析了国际条约在我国适用中存在的问题。

| Abstract: | There are two theories about the relationship between international law and municipal Law: monism and dualism.The author agrees to monism.This contribution discusses the relationship between international law and municipal law from four aspects: basis of the validity of international law,state sovereignty,reservations to treaties and state responsibility.And finally the present article then analyzes the issues in the application of international treaties in China. |
