| 摘 要： | 农民工＂自救式犯罪＂是指当农民工的生存、发展受到威胁或合法权益遭受侵害时,以犯罪的手段来维护自己的权利或权益时而产生的犯罪。法律使用成本过高、立法不完善、执法不严、监督不力是导致农民工＂自救式犯罪＂的客观原因,法律意识淡薄是导致这种犯罪发生的主观原因。只有不断健全民主、完善立法、加大执法力度、增加救济渠道,才能从根本上预防和减少农民工＂自救式犯罪＂的发生。

| Abstract: | The peasant worker＇s crime refers to that when the peasant worker＇s survival and development are threatened or his legal right is infringed upon, the peasant commits crimes with criminal means to maintain his own right or benefit. It is the objective reason for the peasant worker＇ s crime that the cost of using laws is too expensive, legislation is uncompleted, laws are not strictly enacted and supervised and it is the subjective reason for the peasant worker＇ s crime that the worker＇ s legal consciousness is simple. Only by continuously perfecting democracy, completing the law-executed force and increasing the relieving channels can the peasant worker＇s crime be basically prevented and decreased. |
