| 摘 要： | 高校学生人身损害事故可分为与教育管理职能有关和与教育管理职能无关两大类,处理时应遵循过错责任原则为主、公平原则为辅的归责原则。对因自杀、实习以及第三人的行为而引起的学生人身损害事故,应按照民法的精神判令学校的责任。

| Abstract: | The personal injury accident of students in university can be divided into two types: one have something to do with educational management talent and another have nothing to do with educational management talent.We should deal with it following the responsibility principle that it takes the fault liability as the main and the fair liability as assistance.Aiming at the personal injury accidents of student in university because of suicide,practice and the third people's behavior,we should affirm whether school undertakes the civil responsibility or not according to the civil law spirit. |
