| 摘 要： | 依据国际上有关提单的法律、判例和著述,本文对影响海运提单承运人责任的相关因素进行了探讨。这些相关因素有外在因素、中介因素和内在因素。外在因素是指海运提单或提单法本身没有具体规定的内容;中介因素是指由于提单的使用而将外在因素和内在因素联结起来的因素;内在因素是指海运提单或提单法所作的具体规定。此外,本文还涉及具有普遍适用意义的一些理论问题,如有关损害赔偿的债权人减轻损失的义务、间接损失和共同过失等内容。笔者写作的目的在于如何尽量减少船货双方因货损纠纷带来的损失,以促国际贸易和海运业的更大发展。

| Abstract: | In light of the conventions, leading cases and authoritative writings concerning d/l, this paper makes a study of reievant factors affecting carrier's liability. Such factors can be classified into three kinds: outer, t interior and medium, The outer factors denote the part of contents no specifically provided in b/1 or b/1 conventions; the interior factors indicate specific stipulations therein. The medium factors refers to the combination of outer and interior factors in the use of b/1. Moreover, some relenant problems such as mitigation, remote loss and contributary faultare also touched upon in the paper. |
