| 摘 要： | 我国全国人大立法性权力具有双重性质:一方面受人民委托行使立宪、修宪权;另一方面根据宪法的授权行使国家立法权。前者使全国人大成为“最高权力机关”,其立宪、修宪行为不应成为任何国家机关的审查对象;后者则决定其为“国家立法机关”,其立法行为应接受宪法授权的违宪审查机关的审查。我国的违宪审查机关的设立应采用建立宪法法院独立行使违宪审查权的模式,所有国家机关的行为均应接受宪法法院的审查监督。

| Abstract: | The legislative power of the National People's Congress of our country has a double nature: on the one hand,it is entrusted by the people to practise the power of establishing and amending the constitution;on the other hand,it is empowered by the constitution to practise the national legislative power.The former makes NPC the supreme organ of power,the act of establishing and amending of constitution of which should not be the object of investigation of any state organ;the latter makes it the national legislative organ,the legislative act of which should be subject to the investigation of the constitution-empowering investigating organ of unconstitutional acts.The establishment in our country of the investigating organ of unconstitutional acts should adopt the mode of setting up a constitutional court to practise independently the power of investigating unconstitutional acts. |
