| 摘 要： | 随着工业社会化的发展,人们在发展经济的同时,对环境保护的意识也在不断的增强。特别是在环境保护的立法上,各国环境保护法律法规都得到不断完善,一般环境任权民事纠纷的发生已经得到了有效的遏制。但是环境污染行为共同侵害他人合法权益的共同环境侵权民事纠纷并没有减少,相反却有增加的趋势。共同环境侵权作为一种特殊的环境侵权,其责任的构成以及法律救济与一般侵权相比有其特殊性。

| Abstract: | With the development of industrial society, people increasingly concentrate on the consciousness of environ- mental protection, especially on the legislation of it, and general environmental civil disputes have been effectively con- trolled. The civil disputes of the environmental contributory infringement which joint trespass others’legitimate interest resulted from environmental pollution have an increasing trend. As a peculiar environmental infringement, the composing of environmental contributory infringement liability and legal relief has its own distinctiveness compared with the general tort. |
