| 摘 要： | 我国现行的法院体制是在实行高度集权的计划经济的特定历史背景下建立和发展起来的 ,这一体制存在有诸多问题 :市场经济体制的内在要求与法院体制的矛盾日益凸现 ;法院的地位和权力与客观形势发展对其要求极不适应 ;法院独立审判原则与现行执法体制矛盾突出 ;现行审判机构的职权划分 ,无法贯彻经济高效、司法公正的原则。对法院体制改革应采取的对应措施是 :真正落实宪法规定的法院在国家机构中的地位和权力 ;建立健全司法独立的保障制度 ;将地方法院隶属于地方政权的块状结构改为中央统一行使司法权的条状结构 ;建立多元化司法体制 ,实现司法公正。

| Abstract: | Established and developed in the particular historical context when the planned economy was imposed by a high centralism, the existing system of China's court of law has involved a variety of problems in itself: a daily prominence of the contradiction between the internal demand of market economy and the system of court of law, the inadaptability of the court of law's position and power to the demand of development of the social context, an increasing prominence of the contradiction between the court of law's principle of judicial independence and the existing system of imposing law and failure of the existing division of power between judicial organs in carrying the judicial principle of efficiency and justice. Therefore, to reform the existing system of the court of law, corresponding measures should be taken to actually implement the position and power of the court of law prescribed in the constitution, to establish the security system of judicial independence, to transform the fragmentary pattern in which the local court of law is subject to the local government into the linear pattern in which the judicial power is subject universally to the central government and the establish a polygenic judicial system to realize judicial justice. |
