| 摘 要： | "传播淫秽物品罪"的犯罪核心环节是"淫秽信息的传播",可以纳入传播学视野予以解析。传播淫秽物品罪属犯罪形态的传播现象,它的传播要素均显示了与正常传播迥异的特征,如传者身份的隐匿性,动机的恶意性,内容的诲淫性,道德的腐蚀性,价值的缺失性,媒介的微缩性与在线化,受众动机的深层性等特点。因为它是隐秘状态的传播,因此对谁是受众、受众接触淫秽色情与其可能产生畸形性行为、性罪错之间的因果关系的研究目前尚有许多难点,一般认为,通过模仿效应、脱敏效应和引动效应等消极的传播机制而产生社会危害。消费主义意识形态的传播与蔓延对性道德的销蚀及性观念的蜕变,娱乐化大潮席卷下的大众传媒"性话语"对现实的误读及对受众的误导,网络空间的理性缺失等都可能为淫秽色情信息提供传播的生态环境。

| Abstract: | "The crime of spreading pornographic goods" can be explained and analyzed in terms of dissemination science for the key step of this crime is "dissemination of pornographic information".The crime of spreading pornographic goods belongs to disseminating phenomenon in crime-committing categorization.Its disseminating elements all show different features from normal dissemination,e.g.,a hidden identity,evil motive,pornographic contents,corrosive morality,lack of values,miniature and online medium and deep motivation of the audience.A sort of dissemination in hidden state,study of the crime of spreading pornographic goods offers numerous disadvantages for it is hard to determine who is the audience,how it gets in touch with pornography and what abnormal conduct may result and what a causal relation is between error and crime.It is generally believed the crime causes harm to society by negative disseminative mechanisms,such as imitation effect,desensitization effect and actuating effect.The dissemination and spread corrodes and disintegrates sex moral and conception;the "sex activity" in mass media under the wave of infotainment misinterprets the reality and misleads the audience;reasoning is absent in the web-net space.All these are ecological surroundings which may help to spread pornographic information. |
