| 摘 要： | 作为社会主义现代化建设的重要组成部分,西部民族自治地方的法治建设直接关系着西部现代化建设事业的成败.经过数十载的法治建设历程,西部民族自治地方的法治事业取得了举世瞩目的成就,但也面临着困难和挑战,这突出表现在西部民族自治地方法治化进程所采取的基本模式尚未明确、国家立法与少数民族习惯法存在着一定的冲突和摩擦、法律与其他社会规范的调整范围未得到合理界定等方面.基于此,唯有宏观上对西部民族自治地方法治化模式进行创新、实践上对国家立法与少数民族习惯法的关系进行重构、理念上突破"法律万能主义"式的误区,方为加速西部民族自治地方法治化进程的有效路径.

A Paradigm Study Based on Building the Legal System of National Autonomy of the West |

| Abstract: | Building the legal system of national autonomy of the west is an important part of the socialist modernization drive. After decades of development, the building has realized many achievements, yet still faced with many problems. These problems include lack of the clear guiding principle; conflict between law and the customary law; difference between law and other social norms. Therefore, we must adopt the following methods to solve these problems, such as to determine the basic principle of building the legal system of national autonomy of the west; to mediate the relationship between law and the customary law; to clear the application range of law. Only by this way could we build a better legal system of the west. |
