| 摘 要： | 亲告罪制度对于保护被害人利益具有重要价值,但由于我国亲告罪立法范围极其有限,束缚了亲告罪价值的发挥。然而,无论是从逻辑层面、社会层面和理论层面,还是从制度层面、刑事政策层面考虑,亲告罪范围的扩张已经具备了充分的条件,既有制度的基础,又有理论的支撑;既是逻辑的必然,又是刑事政策的要求;既顺应世界潮流,又符合中国国情。

| Abstract: | The crime handled only upon complaint is of great value to protect the interests of the victims,but the extremely limited scope of legislation in China limits its functioning.However,no matter from the logical,social and theoretical aspect,or from the system aspect and criminal policy aspect,the expansion scope of the crime handled only upon complaint has been provided with sufficient conditions.It has not only the basis of system,but also the support of theory;it is not only the inevitable requirement of logical,but also the requirement of criminal policy;it conforms to the world trend and China’s national conditions. |
