| 摘 要： | 对于学界现行通说“未成年人利益最大化原则”,应具体表述为“最有利于未成年人发展原则”。因为无论是从“语义”还是“语用”层面,“利益最大化”表述都值得商榷;同时从法理层面讲,早期论述家庭问题的哲学观点和近代的系统论,都提倡最大程度保障未成年人的社会化。且此原则最直接的渊源也是以保障未成年人发展为目的而提出的“未成年人利益最大化”,因此这一原则相较之前原则具有更加直接的价值判断依据。从法理角度来看,“最有利于未成年人发展原则”的表述有利于贯彻宪法中对于未成年人权利和人才培养等诸多规定,为我国社会主义现代化提供法制保障。

| Abstract: | Regarding the current academic circle saying“the principle of maximizing the interests of child”,it should be specifically stated as“the principle that is most beneficial to the development of child”.Because the expression of“maximization of benefits”is questionable both at the“semantic”and“pragmatic”levels;at the same time,jurisprudentially,whether it is the earliest philosophical perspective on family issues,or modern system theory all advocate the maximum protection of the socialization of minors.And the most direct source of this principle is the“maximization of the interests of child”,which is proposed for the purpose of protecting the development of minors.Therefore,this principle has a more direct basis for value judgment than the previous principle.Therefore,from the perspective of jurisprudence,the expression of“the principle that is most conducive to the development of child”is more conducive to better implementing the constitution’s provisions on the rights of minors and personnel training,and to provide legal guarantee for China’s socialist modernization. |
