| 摘 要： | 随着我国刑事审判方式改革的日益深入,刑事诉讼证人出庭作证制度日趋重要,但与此不协调的是证人出庭率低的情况相当普遍。之所以如此,我国刑事诉讼证人出庭作证制度存在重大缺陷是一个重要原因。今后应完善立法,建立证人出庭作证制度和证人保护制度,同时进一步赋予具有特定身份的证人免予作证的特权并建立证人经济补偿权制度。

| Abstract: | With the increasing deepening of the reform in the judicial procedure in our country,more and more importance is attached to the system of the witness's appearance in court in the criminal proceedings.What is not in line with this advancement,however,is the rather usual case that the witnesses seldom appear in court.This is because there is serious deficiency in our country's system of the witness's appearance in court in the criminal proceedings,which needs badly to be improved in the days to come.In other words,the system of the witness's appearance in court in the criminal proceedings and the system of protecting the witness should be introduced.Meanwhile,a system,which gives the witness of special relationship privileges of not appearing in court and of economic compensation,should be also established. |
