| 摘 要： | 正当防卫是我国刑法中规定的排除社会危害性的行为之一 ,在刑法理论中占有非常重要的地位。从1979年颁布的第一部刑法确立这一制度到 1997年新修订《中华人民共和国刑法》颁布 ,正当防卫制度日趋走向完善。就我国新刑法对正当防卫制度的修改而言 ,其创新之处主要表现在 :对正当防卫的概念、条件作了较为合理的修改 ,充分表明我国刑法中的正当防卫是主观上的防卫意图和客观上的防卫行为的统一 ;防卫过当界定显性化 ,标准客观化 ;对无限防卫权的有限制采纳体现了我国刑法的时代精神 ,表明了无限防卫权的价值意义

| Abstract: | Justifiable defense, as one of the important legal systems, has been confirmed by criminal legislations in every country. Justifiable defense has been stipulated in the national criminal law as one of the acts to be excluded from the behaviors harmful to society, which occupies a very important position in the criminal theory. Since the establishment of this system in the first national criminal law in 1979 till the 1997 revised version of "The Criminal Law Of the People's Republic of China", the system of justifiable defense has been brought to perfection with each passing day. So far as the revision of the justifiable defense in the new national criminal law is concerned, the innovative ideas chiefly lie in the fact that the concept of the justifiable defense and the conditions of the justifiable defense have been reasonably revised, which clearly shows the unification of subjective defense consciousness and objective defense behavior in our criminal law. Justifiable dense has been clearly defined and standardized. The adoption of the limited system of the limitless self-defense right embodies the trend of the times in the field of criminal law and show the valuable meanings of the limitless defense right, but the conditions of the limitless defense should be strictly specified. |
