| 摘 要： | 精神损害赔偿既是一个重大的理论问题,又是一个必须解决的重大的实践问题.广大的"法律消费者"在精神损害赔偿的性质与赔偿数额的决定因素、精神损害赔偿的适用范围、精神损害赔偿的具体方式等方面均存在着认识上的误区,从理论上弄清陷入误区的原因,从而走出精神损害赔偿的误区是正确行使精神损害赔偿请求权的关键.

| Abstract: | Compensation for mental damages is a vita theoretical problem and a major practical problem that must be solved as well. The great majority of legal consumers have wrong knowledge of such things as the properties of compensation for mental damages and the decisive factors of compensation amount, the application scope of compensation for mental damages and specific ways of compensation for mental damages. Theoretically clarifying the causes producing wrong knowledge and truly changing the wrong knowledge of compensation for mental damages is the key to correctly exercise the right to claim damages. |
