| 摘 要： | 从比较法的角度来看,我国民事诉讼法规定的财产保全、先予执行与大陆法系的假扣押、假处分有异曲同工之妙,但二者仍存在明显区别。本文认为,借鉴假扣押与假处分的相关规定,对于完善我国的民事诉讼保全制度将有所助益。

| Abstract: | It seems different in approach but equally satisfied in result with the regulation of enforcement in advance while preservation of assets in the Civil Procedure Law and the conservatory measures in litigation of the continental law system. However, distinct differences can be found between the two. In this paper, the author holds that it will be helpful to improve the preserving procedure for civil litigation in China to use relevant regulations of the conservatory measures in litigation for reference. |
