| 摘 要： | 关于盗窃罪既未遂、未遂的标准，理论界各执一词，导致在司法实践中相同的情节却因为执法者认识不同而有差别悬殊的处理结果。尽管理论界允许“百家争鸣”，但司法界的当务之急却是制定科学、统一的标准，结束司法混乱，维护法律的公正与尊严。本文试从我国刑法理论对于盗窃罪既未遂、未遂标准之争议入手，通过对有些学者提出的观点分析，提出自己关于盗窃罪既遂的界定标准的思考，为统一标准之建立提供参考。

| Abstract: | There're different results of theft crimes in the same state, just because the variety of the standards of the accomplishment theories about the theft crime. Although the controversy of the theorists is accepted, it is urgent to make a scientific standard to end the chaotic complexion in practice. This is needed from the view of maintaining the equality and dignity of the law. With the analysis controversy of the present theorists, this article expounds a new standard which is suitable to solve the problem of the accomplishment of the theft crime. |
