| 摘 要： | 法系是比较法研究中的一个重要概念。当今世界最主要的三大法系是大陆法系、英美法系和社会主义法系。社会主义法系的主要代表国家——中国在历史上属于中华法系。从法律史的角度出发,对大陆法系、英美法系和中华法系三大法系之历史渊源和形成特点进行比较研究时,可以发现一些人类2000年来法制进程的普遍规律,对今天法治社会的建设提供帮助。

| Abstract: | Legal system is an important concept of comparative study of law.Three leading legal systems of the world today are Civil Law System、Anglo-American Legal System and Socialistic Legal System.The representative country of Socialistic Legal System——China belonged to the Chinese Legal System in history.While studying comparatively historical source and forming characteristics of this three legal systems in the perspective of legal history,we can find some universal rules of human＇s legal process in the past two thousands years,which is helpful to the construction of legal society today. |
