| 摘 要： | 在刑法学中，犯罪具有三个特征：社会危害性、刑事违法性和应受惩罚性。犯罪所具有的这三个特征是犯罪概念理论的重要内容，反映的是犯罪的社会政治内容和法律性质，它们各部分内部和相互之间既有区别又有机统一，处处蕴涵着马克思主义唯物辩证法的思想，而三者中具有本质特征的是犯罪的社会危害性，它集中体现了这种哲学价值，因而值得探究。

| Abstract: | In the Criminal Law Studies the crime has three features,that is social harmfulness,unlawfulness and punishment. These three features are the important contents of the criminal conceptual theory,which reflects the social and political content and nature of the crime. Although these three features are different from each ther, they are united as one in essence. Every aspect entails the idea of Marxism material dialectics, among the three features the social harmfulness is the most basic feature, which fully demonstrates the philosophical value and thue is worth further analysis. |
