| 摘 要： | 近年来我国犯罪数量逐年递增,受司法能力和犯罪分子个人经济状况制约,每年有相当规模的刑事被害人难以从犯罪分子手中取得基本的赔偿。为了保护被害人权益,化解社会不稳定因素,国内学者纷纷呼吁参照其他国家的先进理论构建我国刑事被害人国家补偿制度。本文通过对从国外引入的建立该制度的一系列相关学说的批判,并结合社会契约理论,提出了有限国家责任说以及"有限国家责任说与社会保险说—社会福利说"这一理论体系。笔者认为应以此为理论依据,建立我国的刑事被害人国家补偿制度。

| Abstract: | Recently,there is an increase of the crimes in our country and it's not easy for quite a large number of the victims obtain the basic compensation from the criminals every year with the limitations of the judicatory power and the individual economic status of the criminals.In order to protect the rights of the victims and stabilize the unsteady factors of the society,more and more national scholars take the reference of the advanced theories of other countries to construct the compensation system in our country.By exploring the criticism to the relative theories of constructing this system from the foreign countries and combine the social contract theory,this passage proposes the limited country theory and the theoretical system of analysis on the limited country responsibility and social insurance-the social welfare.The author thinks that the construction of the national compensation system of victims can be on the basis of this theory. |
