| 摘 要： | 破产管理人制度与原破产清算组制度相比,法律地位明显提高,选任较为合理,职责更加完善,监督主体多元化。为进一步完善破产管理人制度,我国有必要建立临时破产管理人制度,以招投标方式确定破产管理人的报酬制度,完善破产管理人的法律责任和监督。

| Abstract: | Compared to the original bankruptcy liquidation team system, the bankruptcy administrator system has obtained more advantages of higher legal status, reasonable selection, perfect duties, supervision diversification and the creation of bankruptcy administrator reward system. To further improve the bankruptcy administrator system, China must establish an interim bankruptcy administrator system and a bidding identify bankruptcy administrator reward system to improve the legal responsibility and supervision of the bankruptcy administrator system. |
