| 摘 要： | 在对法律解释学、法律社会学及其二者辩证关系进行分析的基础上，从法律社会学的角度对我国现阶段竞技体育纠纷的类型及过程进行分析，指出以第三方介入的方式解决竞技体育纠纷最为有效，但我国在此方面还存在着明显的缺陷。在解决竞技体育纠纷过程中，将法律解释学与法律社会学相结合，不仅有利于法律与社会的结合，也有利于我国竞技体育纠纷多元化解决机制的构建

| Abstract: | On the basis of analyzing law hermeneutics, law sociology and their dialectical relationship, this article analyzes the types and process of sports disputes of the present stage, from the perspective of law sociology. It points out that the most effective way to resolve competitive sports disputes is through third party intervention, but in China there are still obvious flaws in dealing with the disputes. In the process of resolving the disputes, a combination of law hermeneutics and law sociology is not only beneficial to integrate law into society, but also to the construction of a diversified settling mechanism of competitive sports disputes. |
