| 摘 要： | 目前采用硬法之治的学生体育权利保障效果并不显著,因而以＂软法之治＂为视角来探讨保障学生体育权利实现的新途径。在对学生体育权力软法现状进行分析的基础上,建议改善与学生体育权利的相关软法的制定程序,建立与相关软法相对应的内部申诉制度,促进相关软法的规范化,加强审查监督,避免＂人治现象＂并加大宣传力度,以强化学生体育权利保障中的软法之治。

| Abstract: | Soft law is a new way to guarantee the sports rights of students, as it doesn＇t work well at present to employ hard law to protect students＇ sports rights. This paper, based on a state quo analysis on soft law, suggests improving the enacting formula of soft law related to students＇ sports rights, establishing the corresponding interior redress system, promoting its normalization, strengthening its examination and supervision and avoiding ＂the rule of man＂ and increasing its publicity so as to intensify its functions on guarantee of students＇ sports rights. |
