| 摘 要： | 体育纠纷,是指在体育活动中以及解决与体育相关的各种事务中,各种体育法律关系主体之间发生的,以体育权利义务为内容的矛盾。体育仲裁的强制性,指体育纠纷的当事人必须向国内仲裁机构申请仲裁,不得将体育纠纷向法院提起诉讼的特性。这种强制性的体育仲裁处理体育纠纷问题,不可避免地与法律产生了冲突。我国体育纠纷的争端解决机制可设计3种可供选择的方式:体育仲裁、体育调解和体育诉讼,从而建立起我国体育纠纷争端解决机制的整体框架。

| Abstract: | Sports dispute,which is a social dispute happening among the subjects of sports law relation in sports activities and various affairs related with sports,whose content are sports rights and obligations.Compulsion of sports arbitration,which means the parties concerned in sports conflicts have to apply to the domestic arbitration organization for arbitration rather than the court.In this way,dispute is unavoidable.There are three ways that can be elected in settling sports disputes in China,they are sports arbitration,sports conciliation and sports lawsuit,which set up the whole frame of settling sports disputes in China. |
