| 摘 要： | 软法在当今社会生活的各个领域大量出现，并不断发展、增长，其对公民、法人和其他组织的权利、自由产生了越来越重大的影响。体育软法在规范人们体育行为和调整社会体育关系方面，既有积极的作用，也有消极的作用。通过体育硬法对体育软法的创制和实施进行规范、保障社会共同体成员对体育软法创制和实施过程的广泛和直接参与、保证国家和社会对体育软法创制和实施过程的全面和有效监督，以此来抑制其消极作用。充分发挥和利用其积极作用，从而更好地保障人们的体育权利。
