| 摘 要： | 司法公正是当代中国司法改革的价值目标。司法独立是司法公正的基础和前提。司法独立的要义是司法权的行使要与社会有一段距离 ,司法机关和司法人员不受非法律因素的影响 ,仅依据法律和职业良知对案件事实做出判断 ,因而司法独立包括法院独立和法官独立。

| Abstract: | Judicial fairness is the target of judicial reform in China at the present time and judicial independence is its basis and prerequisite. The key of judicial independence is that there should be a certain distance between the exercising of judicial power and the socity, that judicial organs and judical personnel are not restricted by the factors beyond regulations and that the judges judge the cases according to the law by using their professional intuitive knowledge and special knowledge. So the independence of courts and judges will be contained in the judical independence. |
