| 摘 要： | 目前我国刑事诉讼过程中证人出庭作证率普遍低下,究其原因主要是立法缺失和传统的诉讼观念障碍。文章在分析证人出庭作证面临的一些现实困境后,提出建立证人出庭制度,以此解决刑事证人出庭作证的诸多制度障碍。

| Abstract: | At present,the process rate of criminal witnesses is generally low.The main reason is the inadequate legal system and the traditional concept of litigation.After the analysis of the dilemma of criminal court,we can develop institutions and witnesses rules of procedure to solve the institutional barriers. |
