| 摘 要： | 本文根据数据是否具有人格属性将数据采集的法律冲突归纳为三种情形:获取、保护个人信息与知情、同意权,个人信息与非个人数据的财产属性,以及非个人数据可获取性与特定数据控制权。提出数据产权制度不明和不正当利用技术优势是引发数据采集权利冲突的症结根源。数据采集中权利缺乏保护的背景下,采集数据应以保障人格利益为底线,以共享财产利益为导向,采取法律与技术共治,实现数据采集中各方利益的衡平。

| Abstract: | According to whether the data has personality attribute or not,this paper summarizes the legal conflict of data collection into three situations:obtaining,protecting personal information and right of knowledge and consent,property attribute of personal information and non-personal data,and non-personal data accessibility and control of specific data.It is pointed out that the unclear system of data property rights and the improper use of technological advantages are the crux of the conflict of data acquisition rights.Under the background of lack of protection of rights in data collection,the collection of data should take the protection of personality interests as the bottom line,take the sharing of property interests as the guide,adopt legal and technical co-governance and realize the equity of the interests of all parties in data collection. |
